INDIAN EXPAT TAX SITUATIONS

Cross-border details can change your German tax result.

These are some of the situations that commonly deserve closer attention when an employee moves between India and Germany.

02

You earned salary in India before moving

Pre-arrival Indian employment income can be relevant to the German tax-rate calculation in a part-year residence case. A refund estimate that simply ignores the Indian salary can be misleading.

03

Your spouse stayed in India or joined later

Marital status, residence and each spouse’s German and foreign income can affect whether joint assessment is available and whether it is beneficial.

04

You still receive income from India

Indian interest, investments, rental income or other income may require cross-border analysis. The Germany–India double taxation treaty helps allocate taxing rights and avoid double taxation, but the treatment depends on the type of income.

05

You already moved back to India

You do not need to live in Germany to have previous German employee tax years reviewed. The preliminary review and later tax-return process can be handled remotely.

You had several German employers or tax class VI

Multiple Lohnsteuerbescheinigungen, overlapping employments and tax class VI can affect both the annual result and the filing obligation. Send all certificates for the relevant year.

INDIA–GERMANY CROSS-BORDER INCOME

Indian income should be reviewed, not guessed.

Germany and India have a double taxation agreement. It allocates taxing rights between the two countries; the correct German treatment still depends on the specific type of income, residence status and timing.

For the first review, simply tell us what kind of Indian income you had and the approximate amount. Detailed documents can follow later if necessary.

WHY PROFESSIONAL REVIEW?

A cross-border tax return is more than entering numbers into software.

Your case may involve German residence rules, Progressionsvorbehalt, treaty allocation, foreign tax credits, spouse facts and German payroll withholding at the same time.

FAQ FOR INDIAN EXPATS

Questions before you contact us?

Cross-border tax situations depend heavily on the individual facts. These answers explain the preliminary review process.

I moved from India to Germany during the year. Could I receive a refund?+

Potentially. Part-year German employment can result in a refund, but Indian salary or other relevant foreign income before the move can affect the German tax rate. The complete year should be reviewed.

Do I need to disclose Indian income in Germany?+

Indian income can be relevant depending on your residence, the type and timing of the income and the applicable Germany–India treaty provisions. Do not assume that Indian income can simply be left out of the German review.

What if my spouse was still living in India?+

Your spouse’s residence and income may affect the German assessment. Tell us where your spouse lived during the year, whether and when your spouse moved to Germany, and what income each spouse received.

I moved back to India. Can you still prepare my German return?+

Yes. The service is fully remote, so previous German tax years can be reviewed even if you now live in India.

Do I need to upload my Lohnsteuerbescheinigung immediately?+

No. The upload is optional. You can send a general question first. For a preliminary refund calculation, the German wage tax certificate usually makes the review faster and more reliable.

Is this tax software?+

No. The preliminary review is performed manually from the perspective of a certified German tax advisor. If you decide to proceed, professional tax-return preparation can be discussed separately.
