MOVED FROM INDIA TO GERMANY?

Moved from India to Germany during the year? Your first German tax return could lead to a refund.

If you started working in Germany part-way through the year, German wage tax may not reflect your final annual tax position. A German income tax return can therefore be particularly relevant in your year of arrival.

But there is an important cross-border detail: salary earned in India before your move may affect the German tax rate. I review the German and Indian sides together before estimating the result.

FIRST GERMAN TAX RETURN AFTER RELOCATION

Why moving to Germany during the year can change your tax result.

Your arrival year combines two tax periods that payroll software does not necessarily assess as one cross-border story: the months before Germany and the months after you started German employment.

02

You earned salary in India before relocating

Income from your Indian employment before German residence can still be relevant to the German tax-rate calculation. Ignoring it can make a refund estimate look better than the final tax result.

03

Your move date matters

The date you established residence in Germany helps determine the relevant German tax period. For the preliminary review, tell us when you arrived and when your German employment started.

Your spouse may have joined Germany later

If you were married during the year, your spouse’s residence, relocation date and income can matter. A spouse remaining in India for part of the year does not automatically mean the family facts are irrelevant.

Your German wage tax certificate is the starting point

Your Lohnsteuerbescheinigung shows German gross salary, wage tax withheld and other payroll information. It is one of the most useful documents for assessing whether a refund may be realistic.

You may still have other Indian income

Interest, rental income, dividends or investments can require separate analysis. The correct treatment depends on the income type, residence position and the Germany–India double taxation agreement.

INDIAN SALARY BEFORE YOUR MOVE

Your Indian salary may still matter in Germany.

A common mistake is to calculate the expected German refund using only the German Lohnsteuerbescheinigung. In an arrival-year case, salary earned in India before the move may also be relevant when determining the German tax rate.

For a first review, the key facts are usually your move date, the period in which you worked in India, your approximate Indian employment income and your German wage tax certificate. This allows the arrival year to be assessed as a whole.

WHY PROFESSIONAL REVIEW?

A German refund estimate should not ignore the months before Germany.

Your arrival year can involve German residence rules, Progressionsvorbehalt, the Germany–India treaty, spouse facts and German payroll withholding at the same time. The interaction of these items determines the useful next step.

INDIA → GERMANY TAX FAQ

Questions about your first German tax return?

These are the issues that most often matter when employment moves from India to Germany during the same calendar year.

I moved from India to Germany during the year. Can I get a German tax refund?+

A refund can be possible, particularly if German employment covered only part of the calendar year. The actual result depends on the complete facts, including relevant income before the move.

Does my Indian salary before moving to Germany matter?+

It can. Pre-arrival Indian employment income may be relevant to the German tax-rate calculation in a part-year residence case. It should therefore be included in a proper arrival-year review.

Will Germany tax the same Indian salary again?+

Not necessarily. Taxing rights and the German treatment depend on residence, timing, the income type and the Germany–India double taxation agreement. Relevance for the German tax rate is different from simply taxing the same salary twice.

What information should I send for a first review?+

Your move date, German employment start date, approximate Indian salary before the move and your German Lohnsteuerbescheinigung are especially useful. If married, include your spouse’s residence and income situation as well.

What if my spouse stayed in India and joined later?+

Tell us when your spouse moved, where your spouse lived during the year and what income your spouse received. These facts can affect the German assessment and should be checked rather than assumed.

Can everything be handled remotely?+

Yes. The preliminary review and, if you proceed, the German tax-return process can be handled remotely.
