Have an NRE or NRO account while living in Germany? Your Indian bank interest may need to be declared here.

A common misunderstanding is that interest which is tax-free or already taxed in India can simply be ignored in Germany. For German tax residents, foreign bank interest can fall within the German worldwide-income system.

This can affect NRE accounts, NRO accounts, Indian fixed deposits and FCNR deposits. The German treatment depends on your residence, the income, Indian tax paid and the Germany–India double taxation agreement.

NRE, NRO and FCNR accounts can create different Indian tax results — but Germany must be checked separately.

For German tax purposes, the central questions are whether you are German tax resident, what income was credited and whether Indian tax was paid.

NRO account interest

NRO interest can be subject to Indian taxation. If you are also German tax resident, the German return may still need to include the income, with the India–Germany treaty and any eligible Indian tax considered for double-tax relief.

FCNR deposits

FCNR deposits can receive favorable Indian tax treatment under the applicable Indian rules. German taxation must nevertheless be checked independently when the account holder is German tax resident.

GERMAN WORLDWIDE-INCOME PRINCIPLE

An Indian savings account does not stay outside German tax simply because the bank is abroad.

Germany applies the residence and worldwide-income principle to individuals who are resident here. The Federal Ministry of Finance gives the straightforward example that a German resident with a savings account abroad is generally taxable in Germany on the interest from that foreign account.

The Germany–India double taxation agreement then determines how taxing rights and relief from double taxation interact where India also taxes the interest.

India's income-tax rules retain an exemption for qualifying NRE interest subject to the Indian statutory conditions. Germany applies its own tax law to German residents. The two questions therefore need separate answers.

Under the Common Reporting Standard, Germany receives information from partner jurisdictions about reportable foreign financial accounts held by German residents. The information is forwarded to the competent German tax authorities.

Reportable information can include account balances and capital income such as interest and dividends, as well as certain proceeds from financial assets.

The BZSt receives partner-country information concerning German residents and forwards it to the responsible German state tax authorities for tax administration.

Important: CRS information does not necessarily equal the final German taxable amount. It can nevertheless lead to questions from the Finanzamt, which is why account statements and tax documents should be retained.

Is NRE interest taxable in Germany?+

If you are German tax resident, foreign savings interest is generally relevant under Germany's residence and worldwide-income principle. An Indian exemption for qualifying NRE interest does not automatically create a German exemption.

Do I have to declare NRO interest in Germany?+

NRO interest received while German tax resident can be relevant to your German return. Indian tax paid and the Germany–India treaty must then be considered when determining double-tax relief.

Is FCNR interest also relevant in Germany?+

Potentially yes. Indian tax treatment and German tax treatment are separate questions. Favorable treatment in India does not by itself determine the German result.

What about Indian fixed deposits?+

Interest on an Indian fixed deposit can be relevant foreign capital income while you are German tax resident. The underlying account type and Indian taxation should also be identified.

Can Germany receive information about my Indian account?+

Germany participates in the CRS automatic exchange of financial-account information. For reportable foreign accounts of German residents, information can be transmitted to Germany and forwarded to the competent tax authority.

I forgot to declare Indian interest. What should I do?+

Have the affected German tax years reviewed promptly. Whether a correction is required and how it should be made depends on the amount, the tax effect and the circumstances of the omission.
